You understand that KMS does not have any control over the vehicle selection with which a Dealer will provide you. You understand and agree that you may make no claim against KMS for any problems with vehicle selection.

Vehicle Warranty
You understand that KMS does not warranty the quality or functionality of any vehicles provided to you through the Service and you understand and agree that you may make no claim against KMS for any problems with any vehicle. You understand and agree that in such a case, your claim is against the manufacturer of the vehicle or its Dealer.

Delivery of Vehicle
You understand that KMS does not have any part in the delivery of any vehicle that you may find through the Service and you understand that you may make no claim against KMS for any vehicle delivery problems with any vehicle. You understand that in such a case, your claim is against the Dealer.

Promotional Lists
You understand and agree that by using our Service, your name may be placed on promotional lists to receive emails regarding our Service as well as information from a Dealer. If you wish to be removed from such promotional lists, you understand and agree that you must contact us via email at info@KillerMarketingSystems.com to be removed from such promotional lists.

Arbitration
If we cannot amicably resolve any legal dispute or damage claim that should arise from your interactions with this website and/or KMS, you agree to resolve any such dispute or damage claim by arbitration. The arbitration proceeding shall be conducted in Pima County, AZ, in accordance with the rules of the American Arbitration Association then in effect with one (1) arbitrator to be selected by mutual agreement of both you and KMS. If we cannot agree on an arbitrator, then the American Arbitration Association shall select an arbitrator from the National Panel of Arbitrators. The laws of the state of Arizona shall apply to the arbitration proceedings. You agree that the arbitrator cannot award punitive damages to either of us and agree to be bound by the arbitrator’s findings. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.

You agree that the laws of Pima County in the State of Arizona are to be used with regards to any interactions with this website or KMS.
